Louis Head, the stepfather of Michael Brown, stood above a crowd and repeated those words during the Ferguson riots alongside Brown's mother.
Both were distraught at the grand jury's decision.
Head may have to pay for those words. CNN reports that he is being investigated for inciting a riot.
"We are pursing those comments, and there is a lot of discussion going on about that right now," said Ferguson Police Chief Tom Jackson in a radio interview with Fox News host Sean Hannity on Tuesday.
No charges have been filed, but police are interviewing witnesses.
The night of Nov. 25 was filled with violent protests, looting and arson. A dozen buildings and an unknown number of cars were burned after a grand jury decided not to indict Ferguson, Missouri police officer Darren Wilson in the shooting death of Michael Brown.
St. Louis police responded with tear gas, riot gear and armored vehicles. At least 60 were arrested before order was restored.
