A Florida man is charged with misusing 911 for complaining about his food from a restaurant, police say.

Nelson Agosto is accused of calling 911 on Dec. 18 after eating a meal from a Stuart seafood restaurant. 

Stuart Police report Agosto complaining that his portion was too small so he did not want to pay for his food.

911 dispatch gave Agosto the police non-emergency phone number but Agosto called 911 again, according to court records.

Nelson is ordered to appear before a Martin County judge in January.

Police are asking people to only call 911 for emergencies.
