John Jonchuck competency hearing delayed

A Bay Area man charged in the death of his five-year-old daughter was scheduled to be in front of a judge Monday morning for another competency hearing, but that has been delayed.

Jonchuck is facing a first degree murder charge for the death of his daughter Phoebe. Police say a detective saw Jonchuck throw his daughter Phoebe off of the Dick Misener Bridge in the middle of the night in January 2015.

The mother, recalling the events a year later, told ABC Action News that Phoebe was unable to swim and was scared of the water.

Jonchuck had a history of mental health issues. Three different times since the incident, a judge has ruled him unfit to stand trial.

Prosecutors have said if Jonchuck is eventually able to stand trial and found guilty, they will seek the death penalty.

The judge decided the hearing will be delayed until April 26.
