DADE CITY, FL -- A 33-year-old man has been arrested and charged with shooting at a Pasco County deputy.

Cops say Theofohilus Himber Burns shot at deputy Steven napolean Monday night.  Napolean was responding to a report of shots fired at the Dade Oaks Apartments at Acorn Loop and 14th Street when he encountered a man who pointed a gun at him.

As the deputy took cover, the gunman fired, but Napolean was not hit.

The gunman then ran away.

Burns was spotted sitting on a porch Wednesday evening at 37330 Oak Street and Dade City and was arrested without incident.

Burns spent time in prison from 1994 to 1998 on a manslaughter conviction.

He's now charged with attempted murder.
