Dunkin Donuts attempt to trademark "Best Coffee in America" phrase rejected

Dunkin Donuts was stopped dead in their tracks after an attempt to trademark their brew as the "Best coffee in America", according to a CNN report. 

The U.S. Patent and Trademark Office denied their request for exclusive rights to the phrase, because it's a slogan that merely claims superiority.

The review board said Dunkin Donut's claims were "mere 'puffery' and incapable of functioning as a trademark", considering the product had no distinguishing characteristics that set it apart from other coffees on the market.

The company may still submit evidence to the review board in support of the claim.
