Do Not Call list enforcements questioned

Telemarketer calls can be annoying, especially if you have listed your number with the Do Not Call Registry. And even though that's supposed to prevent most solicitation calls, it doesn't.

Hal Stewart is one of the millions of people complaining about the calls recently. He gets call after call, despite being on the National Do Not Call List since 2005.

Stewart says he's received more than 100 unwanted calls and faxes and can't get them to stop. And he complains to the Federal Trade Commission (FTC) after each call or fax he gets.

The list started in 2003. The public was supposed to sign up and telemarketers were not supposed to call you with a few exceptions.

William Maxson with the FTC says he believes the list and enforcement of violators have been effective and his agency has gone after some big name companies like DirectTV, DishTV and Columbia House.

Maxson says they have collected more than $500 million in fines.

The FTC figures show since the registry began, consumers filed an average of a million complaints yearly, more than 8 million in all.

Yet, the I-Team discovered the FTC took action only 78 times. That's an average of 10 enforcement actions a year.

The FTC says their actions cover nearly 400 businesses and individuals, which is some of the worst offenders.

Do Not Call and Motor Vehicle Repair complaints increased by 17% in 2010 according to the State's Department of Agriculture and Consumer Services.

DOACS took action against two bay area companies for violating Do Not Call in 2010:

ALL STAR HEATING & COOLING, INC.
4377 COMMERCIAL WAY # 169, SPRING HILL, FL 34606
DoNotCall violations, case(s) were just settled. The department received a permanent injunction against All Start Hearing & Cooling and the company paid a $3,000 fine.
The case started with 21 consumer complaints that were worked down to 4 complaints at $750 per complaint.

This case is still being processed through civil court after the state brought action against them based on 72 consumer complaints. Additional complaints are being reviewed.
