OCEAN CITY, Md. - A Florida man arrested for disorderly conduct says candy was thrown at him by teenagers and he wasn't drunk at the time.
Maryland State Police said 47-year-old Joseph David DiVanna of Sarasota, Fla. was arrested around 9:15 wearing a baby's costume on Halloween night.
State Police say witnesses reported DiVanna cursed at both adults and children in a Maryland neighborhood as he demanded candy.
DiVanna said he was wearing a full baby costume complete with a T-shirt, bib, bonnet and a diaper and believes neighbors were upset that he was trick-or-treating. He said he thinks they called the police to get him to stop.
DiVanna said he had been drinking, but was not drunk. He says he was also provoked by the teens, who he said were the ones acting disorderly.
