Instagram is facing a class action lawsuit in reaction to the mobile photo sharing app's changed Terms of Service.

CNN reports that the suit was filed in San Francisco and appears to be the first civil lawsuit filed claiming a breach of contract.

Last week , Instagram announced it had changed its policy which suggested it would sell users' photos without compensation and introduced a clause which would force users to waive their rights to file a class action lawsuit in most circumstances, according to CNN.

After users responded, the company's CEO retracted the new clause about using photographs without compensation, but kept the arbitration clause as well as one saying it will display ads based on user content.

The lawsuit claims breach of contract on behalf of the woman filing and others also affected.
