LAKELAND, FL - One man is dead and another is in jail after a fatal accident last night in Lakeland.

 Police officers say passersby began calling at about 2am to report a car accident on Griffin Road.

When Officers arrived they say 67 year old Kenneth Spooner was lying on the pavement. Spooner was later pronounced dead on the scene.

Police say the driver of the other car, Damian Hernandez, fled on foot. He was arrested a short time after the accident.

Investigators say they believe both drivers were traveling eastbound on Griffin Road. Hernandez was driving a 2004 Nissan when police say he hit from behind the Motorcycle Spooner was driving.

Police say Spooner was thrown from his motorcycle, and Hernandez lost control of his car and flipped it.

The passenger in the car, Jeremy Edinger, suffered minor injuries. He was treated and released.

Hernandez has been charged with leaving the scene of a fatality without rendering aid, battery on a
Police Dog, and resisting arrest without violence.

The investigation continues, and additional charges may be filed.
