OFFICIAL RULES

ELIGIBILITY: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Open to legal residents of Florida located in the Tampa/St. Petersburg DMA viewing area, who are 18 years or older at the time of entry. Employees of WFTS – ABC Action News (“Sponsor”), its parent corporation, subsidiaries, affiliates, prize suppliers (Moroch Entertainment), and advertising and promotion agencies, and their immediate families (spouse, parents, children, siblings and their spouses) and individuals living in the same household of as such employees are ineligible. Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law. By participating, entrants agree to be bound by the official Rules and the decisions of Sponsor.

HOW TO ENTER: Contest begins 12:01 AM Eastern Standard Time (EST) January 1, 2009 and ends 11:59 PM E.S.T. December 31, 2009 (“Entry Period”). Log on to abcactionnews.com and fill out official registration form. Limit one entry per person per per email address during entry period. Incomplete entries are void. Entries become the property of Sponsor and will not be returned. In case of multiple entries, only the first entry received will be considered. In the event of dispute, electronic entries will be deemed to have been submitted by the authorized account holder of the e-mail address at the time of the sweepstakes. The authorized account holder is the person to whom the applicable internet service provider or other organization (such as business or educational institution) has assigned the e-mail address.

Random Drawing: Winners will be randomly chosen from all eligible entries received at time of drawing. Numerous random drawings will occur, as Sponsor obtains dvds for giveaway. Sponsor is unable to predict when those drawings will occur, but will post the dvd it obtains to be given away and the date of the random drawing at least 10 days before the drawing. Non-winning entries for any drawing will be included in next random drawing. Winner may re-enter 30 days after receiving notification of winning a dvd. All prizes will be awarded. Odds of winning any prize depends on the number of eligible entries received at the time of the drawing.

PRIZES: For each random drawing, one (1) dvd, cd or video game (titles will vary) A.P.V. $25.00 or less. Or one (1) dvd pack, cd pack or video game pack (titles will vary) A.P.V. $100.00 or less. There will be no substitutions for prizes except due to unavailability, in which case a prize of equal or great value will be awarded at the exclusive discretion of the Sponsor. Prizes are not transferable, assignable or redeemable for cash. All applicable taxes are the sole responsibility of the winner. Prizes must be picked up at the ABC Action News studios located at 4045 N. Himes Ave. Tampa, Florida 33607 during normal business hours, Monday – Friday 8:30am – 5:30pm excluding holidays. No prizes will be mailed. All winners must produce picture or some other form of proper identification to claim any prize.

NOTIFICATION: Winners will be notified by email and telephone and may be required to complete an affidavit of eligibility, liability release, and, where legal, a publicity release within 30 days of being notified as a winner. Failure to sign the affidavit of eligibility or, liability/publicity release within 30 days of notification or return of any prize/prize notification as undeliverable will result in forfeiture of the prize and a new winner will be selected by random drawing. By entering, winner agrees to waive any and all claims against the Sponsor, Moroch Entertainment, their parent corporations, subsidiaries, affiliates, officers, directors, employees, agents, and representatives for personal injury or loss that may occur from the participation in this sweepstakes or from the receipt or use of any prize, and grant to sponsor the right to publicize such winner’s name/likeness and entry materials, in any editorial content, public relations materials, promotional or advertising on behalf of Sponsor without additional compensation or consideration unless prohibited by law

GENERAL CONDITIONS: Sponsor not responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the promotion, whether caused by computer, technical or human error. Winners assume all liability and agree to hold Sponsor harmless for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Sponsor is not responsible for late, lost, damaged, incomplete, illegible, faulty, or incorrect transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind, any damage to any person’s computer related to or resulting from participating in the online portion of the promotion, lost or unavailable network connection, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability t participate in the sweepstakes whether caused by computer, technical or human error. Sponsor reserved the right to cancel or modify the program for any reason, including but not limited to , destruction of the integrity of the promotion by fraud, misconduct or technical failures, or if a computer virus, bug or other technical problem corrupts the administration, security, or proper administration of the promotion as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify, freeze or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE WWW.ABCACTIONNEWS.COM OR UNDERMINE THE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMIAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO FULL EXTENT PERMITTED BY LAW.
